1. Agreement and provider
These Terms of Use are an agreement between you and Epicalin LLC, doing business as HouseManual, at 1810 N Burning Bush Ln, Mount Prospect, IL 60056, United States (“HouseManual,” “we,” “us,” or “our”). By creating an account, accessing the service, or downloading or using the app, you agree to these terms and our Privacy Policy. If you do not agree, do not use HouseManual.
2. Eligibility and authority
You must be at least 13 and legally able to enter this agreement. If you use HouseManual for an organization, you represent that you have authority to bind it and “you” includes that organization. You may document, administer, sponsor, or share a property only when you have the right or permission to do so. Do not violate a lease, contract, confidentiality duty, privacy right, intellectual-property right, or law.
3. Accounts and security
HouseManual requires a supported Apple or Google sign-in for account-based features. Keep your device and provider account secure, provide accurate information, and promptly tell us about suspected unauthorized use. You may not share credentials, impersonate another person, create accounts through deception, or transfer an account outside supported staff, sponsorship, invitation, or handoff features. You are responsible for activity under your account until it is secured or terminated.
4. License to use HouseManual
Subject to these terms and applicable store rules, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use HouseManual on devices you own or control. A lifetime purchase is a perpetual license to the purchased version and supported service features, not ownership of the software. Store family sharing or volume purchasing applies only when the store permits it.
Staff, sponsored, complimentary, partner, and organization licenses may be limited by role, capability, property, item count, organization status, term, or sponsor agreement. They are personal to the verified beneficiary, may not be resold, and may be changed or revoked by an authorized organization administrator or HouseManual when the grant expires, the relationship ends, payment fails, an invitation is withdrawn, or misuse occurs. Revocation does not delete local records or prevent export of data the user is entitled to retain.
5. Purchases and auto-renewing subscriptions
Paid personal access may be offered as a one-time lifetime purchase or an auto-renewing monthly or annual subscription. The purchase screen displays the current price, billing period, included capabilities, and renewal terms before checkout. Prices and taxes may vary by country and store. Apple or Google processes payment and provides the authoritative transaction terms.
A subscription automatically renews unless canceled through the same App Store or Google Play account within the period required by that store before renewal. You can manage or cancel it from HouseManual’s subscription link or the store account settings. Cancellation stops future renewal but normally leaves access active through the paid period; refund eligibility is governed by the store and applicable law. Deleting the app or HouseManual account does not cancel a subscription. Restore Purchases may reconnect an eligible store purchase to a verified HouseManual account, subject to anti-fraud controls.
6. Your content
You retain ownership of content you create or import. You grant HouseManual only the limited rights needed to process that content on your device, create an export you request, send it to a backup provider you enable, or provide support you explicitly request. You are responsible for accuracy, legality, permissions, backups, recipients, and appropriate redaction. Do not store illegal material, malicious files, broadly reusable secrets, or information that creates unnecessary risk.
7. Safety and professional limits
Do not rely on HouseManual as the only source in an emergency. Leave unsafe conditions, contact emergency services or the utility from a safe place, follow labels and current official instructions, and use qualified professionals. HouseManual does not inspect a property, diagnose conditions, certify work, determine code compliance, establish legal disclosures, or decide whether a task is safe for you.
Manual discovery, optical character recognition, recall matching, generated links, reminders, and transfer guidance can be incomplete, outdated, or wrong. Confirm safety-critical information and the exact model, document revision, procedure, and authority before acting.
8. Handoffs, exports, and legal disclosures
A home handoff is not a substitute for a seller disclosure, inspection, lease, warranty notice, property record, or legally required document. You remain responsible for disclosure and recordkeeping duties. Review every PDF, archive, transfer package, photo, and attachment before sharing. Once content leaves the app, HouseManual cannot retrieve, revoke, or erase it.
9. Backups and data loss
iCloud and Google Drive backups depend on device state, network availability, provider authorization, quotas, operating-system scheduling, and third-party services. A status indicator is not a guarantee that every record can be restored. Maintain an independent manual export where appropriate and test recovery for important records. Do not erase or uninstall the app before confirming a usable copy exists. To the extent permitted by law, you assume the risk of data loss not caused by our failure to use reasonable care.
10. Third-party services and content
HouseManual may interact with Apple, Google, Cloudflare, manufacturers, document sources, the U.S. Consumer Product Safety Commission, email, calendar, or other services. Their terms and privacy policies apply. A link or discovered document does not imply endorsement and is not a guarantee of accuracy, safety, availability, continued access, or redistribution rights. You must comply with third-party terms when using those services.
11. Acceptable use
You may not interfere with security or operation; probe or bypass access controls; introduce malware; upload content you lack rights to use; scrape, overload, or automate abusive traffic; reverse engineer except where law expressly permits; impersonate others; use the service for unlawful surveillance or unauthorized entry; share invitation codes outside their intended recipients; evade license limits; or use HouseManual to facilitate harm or hazardous work.
12. Intellectual property and feedback
HouseManual’s software, branding, design, documentation, and original website content are owned by Epicalin LLC or its licensors and protected by law. Except for the limited license above, no rights are transferred. If you voluntarily provide product feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation, without identifying you publicly unless you consent.
13. Suspension, termination, and account deletion
You may stop using HouseManual at any time and may delete your account as described on the Account Deletion page. We may suspend or terminate service access for material breach, fraud, security risk, unlawful activity, nonpayment, provider or store requirements, or discontinuation, using reasonable notice where appropriate. Sections that by nature should survive—such as ownership, payment obligations, disclaimers, liability limits, and dispute terms—continue after termination.
14. Changes and availability
We may update the app, features, prices, supported platforms, or these terms. We will provide notice of material term changes as required, and continued use after the effective date constitutes acceptance where permitted. Preview builds may be incomplete. We may discontinue a feature while honoring mandatory consumer and store obligations.
15. Disclaimers
To the fullest extent permitted by law, HouseManual is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free records, and suitability for emergency or safety-critical reliance. Nothing in these terms excludes a warranty or right that applicable law does not allow us to exclude.
16. Limitation of liability
To the fullest extent permitted by law, Epicalin LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, loss of data, loss of goodwill, property damage, personal injury, or decisions based on inaccurate or incomplete records. Our aggregate liability arising from HouseManual will not exceed the greater of US $100 or the amount you paid to us through the applicable store during the 12 months before the claim. These limits do not apply where prohibited or to liability that cannot legally be limited.
17. Indemnity
To the extent permitted by law, you will defend and indemnify Epicalin LLC from third-party claims arising from your unlawful content, unauthorized property documentation or sharing, violation of another person’s rights, misuse of the service, or material breach of these terms. This obligation does not apply to the extent a claim results from our own unlawful conduct.
18. Governing law and disputes
Illinois law governs these terms without regard to conflict-of-law rules, except where the mandatory law of your residence applies. Subject to mandatory consumer rights, disputes will be brought in the state or federal courts serving Cook County, Illinois, and each party consents to their jurisdiction. Before filing, please contact us and allow 30 days for a good-faith attempt to resolve the issue. Nothing prevents either party from seeking appropriate emergency injunctive relief.
19. Apple App Store additional terms
If you obtained HouseManual from Apple: (a) these terms are between you and Epicalin LLC, not Apple; (b) Epicalin LLC, not Apple, is responsible for the app and its content, maintenance, support, warranties, product claims, legal or regulatory claims, and intellectual-property claims; (c) your license is limited to Apple-branded products you own or control as permitted by Apple’s Usage Rules, including eligible Family Sharing or volume purchasing; (d) Apple has no obligation to provide maintenance or support and may refund the purchase price where required by its rules if the app fails an applicable warranty, after which Apple has no further warranty obligation to the maximum extent permitted by law; (e) you represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited-party list; (f) you must comply with applicable third-party terms; and (g) Apple and its subsidiaries are third-party beneficiaries entitled to enforce this section.
20. General terms
These terms and the Privacy Policy are the complete agreement for the consumer service unless a separate signed business agreement applies. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a term is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a merger, reorganization, asset transfer, or by operation of law. Headings are for convenience only.
